Refugee protection

The following sections contain information on the most important international treaties and agreements of which Liberia is signatory, as well as national legislation relevant to the protection of refugees.

Liberia is signatory to the majority of international protection treaties relating to refugees and asylum seekers, including the 1951 Convention Relating to the Status of Refugees, as well as its 1967 Protocol. Furthermore, Liberia is signatory to the 1969 OAU Convention Governing the Specific Aspects of Refugee Problems in Africa as well as the 2009 OAU Convention for the Protection and Assistance of Internally Displaced Persons in Africa (Kampala Convention). Finally, Liberia also acceded to the UN Conventions on Stateless, including the 1954 Convention Relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness. 

Despite significant engagement with the international protection frameworks, Liberia lacks an established national statelessness determination procedure, largely due to resource restraints. Furthermore, Liberia’s Constitution as it stands raises concerns around the protection of individuals born abroad of a non-Liberian father. This concern is bolstered by the Alien and Nationality Law (ANL) that discriminates against persons born in Liberia who are not of a particular descent, barring them from acquiring Liberian nationality at birth. However, the UNHCR has provided recommendations that include taking further steps to amend the ANL, as well as strengthen the protective legal frameworks for stateless persons.

NRC provides information, counselling and legal assistance to assist returnees to resolve land disputes and secure their tenure in land. The project’s activities are organised into three pillars: land dispute resolution; building the capacity of individuals, communities and institutions involved in resolving land disputes; and advocating for systemic solutions to insecure land tenure in Liberia. NRC provides legal assistance, usually through individual casework, but it may also entail class action. NRC pursues legal action through all relevant local, national and international legal systems and mechanisms, including customary law, conflict resolution and mediation mechanisms and any other prevalent systems of law – in addition to statutory law and the courts. NRC may provide training in legal issues to target groups and key local actors – to establish a platform of understanding of rights and applicable law, and subsequent legal approaches to key issues.

Second Chance works with former child soldiers and war victims to promote psychological healing (dealing with issues such as trauma, depression and substance abuse), employment and socio-economic stability. They also work to educate the local community about psychological difficulties including sensitising parents and teachers to direct and secondary trauma in children.

WOSI is a women-focus group working to alleviate abuses and exploitation of women and girls as well as provide them with opportunities that enable them rebuild their lives and cater to their families and contribute to communities. The have conducted a survey on FGM/C in Liberia showing the attitudes of people towards FGM/C. WOSI is involved in outreach activities aimed at changing behaviour and attitudes of the people and reduced the prevalence of FGM/C of 10% in targeted communities, over a one year period.
